In view of the frequent high-priced signings of football clubs in the transfer market, the Chinese Football Association has introduced a system of transfer adjustment fee. In order to explore the legitimacy and rationality of the transfer adjustment fee, the rules of transfer adjustment fee are analyzed around the subject and procedure of rulemaking and the nature of the adjustment fee by using methods of comparison and contrast, historical research and some others. Examining the transfer adjustment fee from the perspective of procedures and entities, we can find that the design of the rules is not self-consistent, the formulation of the rules deviates from the procedural justice, and the introduction of the rules violates the principle of proportionality. Under this premise, it is proposed that the Chinese Football Association should enhance the self-consistency of rule design, highlight the autonomy of association and respect the law of professional league development so as to explore the rule system suitable for the development of local professional football under the rule of law. |
