The event company is the initiator and manager of the e-sports league. Based on its own game copyrights, it maintains the basic internal order of the e-sports league by formulating and exercising disciplinary penalties. However, due to the lack of consideration about the legitimacy and legality of the system itself, the e-sports league led by the competition company has encountered problems such as abuse of the right to amend the rules, improper punishment procedures, and no relief for the punished when implementing disciplinary punishments. All of this is rooted in the abuse of power within the e-sports league, resulting in an imbalance of rights and obligations between the e-sports league and its management objects. Therefore, the author put forward corresponding suggestions by clarifying the nature of the right to define the disciplinary punishment power of the e-sports league, and analyzing the specific problems in the actual application of disciplinary punishment. Specifically, to improve the discipline and punishment of the e-sports industry, we should establish a collective bargaining system for the e-sports alliance and build a democratic alliance governance model; at the rule-making level, we should adhere to democratic formulation procedures and lead multiple parties within the alliance to participate in rule-making; and finally, we should improve the alliance internal appeal arbitration, as well as the connection of independent external arbitration, so as to provide institutional guarantee for players′ right to appeal. |
