运用文献资料法、对比分析法和专家访谈法,梳理相关概念、政策,认为创意保护是我国自主品牌赛事创新发展的基础。以美国、欧洲以及中国体育赛事创意保护为例,分析目前我国法规框架下,与知识产权相关的商标法、专利法和著作权法对自主品牌体育赛事创意的保护实践。发现我国体育赛事创意确权存在产权保护力度不足、创意所有人保护意识薄弱和创意产权经营环节缺失三大困境。建议体育政府部门加强顶层设计,在《体育法》修改中体现创意产权的保护思想,积极探索创意产权保护的新型举措;建议赛事组织者加强创意保护意识,围绕创意产生的不同阶段,实施科学的、联合的保护模式,达到尽可能全面的保护范围,并在此基础上做好创意产权交易流转的工作。 |

By using the methods of literature review, comparative analysis and expert interview, this paper firstly clarified the topic-related concepts and policies, holding that idea protection is the basis for innovative development of China's self-owned sports events. Based on a case study of the idea protection of sports events in the United States, Europe and China, this paper then analyzed the practice of protecting the ideas of independent brand sports events in the trademark law, patent law and copyright law which are related to intellectual property under the current legal framework of China. It is found that there are three dilemmas in the confirmation of idea rights for sports events in China: insufficient protection of property rights, inadequate protection awareness of the idea owners and lack of idea property right management links. It is suggested that sports government departments should strengthen top-level design, manifest the view of protecting idea property rights in the amendment of Sports Law, and actively explore new measures of idea property rights protection. It is also suggested that the sports event organizers strengthen the awareness of idea protection, implement scientific and joint protection mode around the different stages of idea production to achieve as comprehensive protection as possible, and accordingly do a good job in the idea property rights trading and circulation. |
